About the EB-2 Category

The EB-2 category is the second employment-based preference category covering immigrants with advanced degrees or exceptional abilities. It is most often recommended for medical professionals, scientists, and university professors. In many cases however, business managers or individuals in other fields may qualify based on their academic or employment history. Who Can Be Eligible for EB-2 Visa?

Eligible applicants, whether as advanced degree holders or professionals with exceptional ability, should obtain a labor certification and exhibit the following:

For advanced degree holders:

  • proof of advanced degree or its equivalent
  • five (5) years of progressive work experience relevant to the advanced degree

For those with exceptional ability:

    • exceptional ability in the sciences, arts, or business that can significantly benefit the future of the US economy, cultural or educational interests, or welfare
    • in lieu of a labor certification, you may file for a National Interest waiver

National Interest Waiver

A National Interest waiver exempts eligible EB-2 immigrants from the labor certification process and job offer requirements. Applicants may file a petition on their behalf without needing an employer as their sponsor.
