About

The EB-5 Visa, also known as the “Immigrant Investor” visa, allows non-US investors (and their eligible relatives) to apply for permanent residence by investing in a commercial enterprise in the United States.

EB-5 visa holders can invest in any of the following:

  • sole proprietorship
  • partnership (limited or general)
  • holding company
  • joint venture
  • corporation
  • business trust
  • other entity, either privately or publicly owned

Minimum Investment Amounts

On March 10, 2022, Congress approved the EB-5 Reform and Integrity Act of 2022, reauthorizing the EB-5 Regional Center Program until September 30, 2027. The reauthorization also adjusted the minimum investment amounts to be as follows:

  • Targeted Employment Area (TEA) investments: $800,000
  • Standard EB-5 investments: $1,050,000

TEA Investments

What Is a Targeted Employment Area (TEA)?

A Targeted Employment Area is an area that meets these criteria:

  • a rural area with high unemployment
  • fewer than 20,000 population
  • unemployment rate should at least be 150% of the national average

  • smaller investment capital needed
  • investors may establish indirect job creation because principally doing business applies to the job-creating entity, not the new commercial enterprise.
